Shanghai Maritime Safety Administration (MSA) announcement on strengthening the safety Management of ships with machinery failure – Effected from 1/6/2022 to 1/6/2024.

Through the attached correspondence “Huatai Marine” Circular No. PNI (2022) issued on 2/6/2022, it was announced that from 1st of July 2022 until 1st of July 2024, Shanghai MSA’s aims to “strengthen the management of ships with machinery failure in navigation to ensure the safety of ships entering and leaving Shanghai port and maintain the safety and order of maritime traffic”.

To this end, ships shall report to the Maritime Safety Administration Command Center Under its Jurisdiction machinery failures , whilst after the ship is in a stable and safe condition, the following measures shall be taken in timely manner:
1. Submit a written report of ship’s incident and measures taken
2. Conduct investigation and analysis, formulating corrective actions and review of SMS submitting the management review to MSA for verification (this applies to ships which hold SMCs)

Not trustfully reports will result imposing a punishment in accordance with Article 100 of MTSL of the People’s Republic of China.

The following cases will lead those ships subject to accident investigation and safety inspection by MSA:
1. Machinery failure occurs within traffic lanes and precautionary areas.
2. Machinery failure occurs in waters apart from those stated in 1 and the repair time exceeds 2 hours.
3. Close quarter situations, accidents caused by machinery failure, which obviously affected traffic safety order under the jurisdiction.
4. Machinery failure occurred twice or above in Shanghai Port waters within 12 months.
5. Within 12 months, ships run by the same Owners, Operators or Managers have suffered 3 or more machinery failures in the waters of Shanghai Port, and the cumulative number of machinery failures during this period exceeds 10% of the total.

Shanghai MSA will maintain a list of vessels that fall into category 4 or 5 as detailed above. Designated as a ‘listed ship’, these vessels could face a ban from entering the port or expulsion if defects are not rectified to the satisfaction of the Shanghai MSA. Furthermore, listed vessels will be subject to more onerous requirements prior to entering waters under the jurisdiction of the Shanghai MSA.

Masters, Owners, Operators and Managers is highly recommended to ensure the effective implementation of their SMS especially the routine maintenance and testing of ships’ machinery equipment, including:
1. a detailed technical inspection self-inspection, testing of ship’s machinery, to ensure that they are in a reliable working condition.
2. that crew members are familiar with their duties and emergency response measures to be taken in the event of machinery failure.
3. Training the crew to ensure that the relevant personnel exercise the corresponding due vigilance and precautions when entering Shanghai Port waters.
